These Terms of Use govern all bookings and interactions between users of VisitBavaria.travel (“the Platform”) and XCIERGE, FZE (“the Provider,” “we,” or “us”).

2. Acceptance of Bookings

Bookings are only accepted from individuals with full legal capacity.
Legal entities may book only through a duly authorized representative.

3. Accuracy of Information

All information submitted through VisitBavaria.travel must be true and complete.
If incorrect or misleading information is provided, we reserve the right to cancel the booking.
Payments made in such cases are non-refundable.

4. Arrival and Compliance With Travel Requirements

You are responsible for arriving at the designated meeting point on time.
If traveling internationally, you must ensure that you:

  • Possess all required travel documents (passport, visa, etc.), and

  • Comply with applicable health or entry regulations.

No refund is issued for missed tours due to failure to meet these obligations.

5. Conditions of Participation

You must meet all stated participation requirements for your activity (e.g., physical condition, age limits).
We may exclude participants who fail to meet these conditions or who endanger themselves or others.
Refunds will not be granted in such cases.

6. Binding Nature of Booking Requests

A contract is concluded when we confirm your booking via email.

By placing a booking request, you make a binding offer that remains valid for two (2) working days.
If accepted within this period, the booking becomes legally binding.

7. Payment Terms

Unless otherwise stated, full payment is due at the time of booking.

For selected tours, we may allow payment in installments as follows:

  • A 50% deposit is due at the time of booking.

  • The remaining 50% balance is due no later than 4 weeks (28 days) before the scheduled tour date.

Payments may be made via bank transfer or credit card.

Promo Code “Get10off”

  • Requires full payment at the time of booking.

  • A 10% discount applies to the total tour price.

  • Earlybird and all other discounted bookings are strictly non-refundable.

If any payment deadline is not met, the booking will be treated as canceled by the customer, and the applicable cancellation fees under Section 11 (Cancellation Policy) will apply.

8. Waiver of Right of Withdrawal

To the extent permitted by applicable law, you waive any statutory right of withdrawal for tourism services that are scheduled for a specific date or period.

9. Insurance Responsibility

Tour prices do not include travel, health, accident, or cancellation insurance.
You are solely responsible for arranging adequate insurance coverage.

10. Failure to Pay

If you fail to pay for the service or initiate a payment reversal (chargeback), your booking is forfeited.
This is treated as a cancellation, and the cancellation terms in Section 11 apply.

11. Cancellation Policy

For cancellations initiated by you, the following conditions apply:

  • Free cancellation up to 28 days (4 weeks) before the tour

  • 50% charge for cancellations 15–27 days before the tour

  • 100% charge for cancellations 14 days or less, or no-shows

Additionally:

  • All credit card or processing fees are non-refundable.

  • All bookings during Oktoberfest, and all discounted or promotional bookings (including earlybird), are strictly non-refundable under all circumstances.

12. Extraordinary Cancellation by the Provider

We may cancel a tour without notice if unforeseeable or unavoidable circumstances make the activity impossible or unsafe, including but not limited to:

  • Severe weather conditions

  • Government restrictions (e.g., pandemic measures)

  • Safety concerns

  • Force majeure events

In such cases, we may offer rebooking or credit at our discretion.

13. Exclusion From Participation

We may exclude any participant who:

  • Fails to meet participation requirements

  • Poses a risk to themselves or others

  • Disrupts the program significantly

No refund will be issued.

14. Program Changes

Minor adjustments to the itinerary or program may occur due to operational or environmental circumstances.

If you arrive late, the Provider may shorten or modify the tour to ensure that subsequent activities remain on schedule.
Refunds will not be issued for shortened tours due to late arrival.

15. Time Zone

All deadlines, time calculations, and scheduling matters are based on the provider’s local time zone: Gulf Standard Time (GST), UTC+4.

16. Liability

Our liability is limited to the maximum extent permitted under applicable UAE law.
We are not liable for:

  • Losses caused by your failure to comply with instructions

  • Delays or disruptions caused by force majeure

  • Personal items lost during the tour

Nothing in these terms limits liability where prohibited by law.

17. Amendments to These Terms

We may update these Terms of Use at any time without prior notice.
The version in effect at the time of booking applies.
You are not entitled to future bookings under the same terms.

18. Governing Law & Jurisdiction

These Terms of Use are governed by the laws of the United Arab Emirates.

If you are a consumer residing in another country, mandatory consumer protection laws of your country remain applicable.

Unless mandatory laws dictate otherwise, the exclusive place of jurisdiction is Dubai, United Arab Emirates.

19. Severability Clause

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in full force and effect.
